Just got this note from a savvy marketing mavin: “
With Facebook now receiving more traffic than Google, it is arguably one of the most important marketing tools for any business. In fact, CNN says 43% of businesses are using custom Facebook pages to gain new business.”

 
So I looked on the Internet for further information about the power of social networks.

 
“The most influential news-sharers, and the group which shared 87% of the stories in the survey, only accounted for 27% of all the users - tallying with previous definitions of a minority of highly active web web users that contribute a majority of content online.

 
“The big social networks - Facebook Twitter, YouTube and MySpace, accounted for 43% of all links shared, email 30%, SMS 15% and instant messenger 12%. “Researchers identified three primary motivations for sharing, which differed around the world. Current Legal Status
 
Your company's overall pricing policy needs to be consistent and reflected in the appropriate contract, SOP and other documentation.

Traditional law in the US was based on a 1911 Supreme Court case
1 that held a manufacturer-enforced "Minimum Retail Price" was a "per se" antitrust violation. 

In 2007 the Supreme Court changed that rule
2 and decided that MRP clauses in contracts between manufacturer and distributor would not longer be considered a "per se" violation of the law. Now each case has to be decided on its own merits.

Among the early decisions creating exceptions to the "per se" rule, allowance was made for "Minimum Advertised Price" requirements in contracts. That's why discount electronics companies used to advertise something like, "Ask us for our best price..."

In the current regulatory climate, it is often safest to do a MAP rather than a MRP.


But, especially where there is more than just distributing; where, for example there is also a license to use a certain patent, technology or trademark and trade dress, I believe it would be safe to have an MRP, especially if the contract term links the pricing to the license.

In addition to this major change in the US rule just a couple years ago, the MRP rules are rather different from country to country. We will review the situation in the EU in another VL Update eMemo.
